Position Overview:
Restaurant Brands International, Inc. (RBI) the owner of the BURGER KING®, TIM HORTONS®, POPEYES® and FIREHOUSE SUBS® brands, and one of the largest quick service restaurant companies in the world, is seeking a Marketing & Intellectual Property (IP) lawyer to work at its Restaurant Support Center in Miami, Florida. The attorney will play a key role in the RBI Legal Department’s Marketing team and serve as a critical partner to the Marketing Departments for the BURGER KING®, POPEYES®, TIM HORTONS® and FIREHOUSE SUBS® brands in the U.S., including Digital Marketing, Product Innovation, Privacy, and Sustainability. The attorney is also responsible for assisting in management of the worldwide trademark and other intellectual property (IP) portfolios of the RBI brands. The attorney will also assist in supporting and coordinating with regional counsel advising marketing teams outside the U.S.
The Marketing & IP Counsel is a Director-level role that interacts frequently with all levels of leadership within the brand marketing departments, communications department and other attorneys and paralegals within the Legal Department. The attorney will also work closely with outside counsel and counsel for agencies providing services to the RBI brands.

Marketing – Essential Duties
- Review and approve advertising and promotional materials across all media (e.g., digital, social, television, radio, print), for legal compliance
- Draft and negotiate various marketing, public relations and promotions-related agreements, including advertising agency agreements, trademark licenses, promotion and sponsorship agreements, media buying agreements, professional services ageements and vendor agreements
- Counsel and advise on compliance with consumer protection, intellectual property, rights of publicity, and privacy laws (e.g., CAN-SPAM Act, COPPA, TCPA) in connection with advertising and marketing initiatives including advice on food claims and substantiation
- Manage and oversee legal compliance for promotional activities, including the execution of sweepstakes, contests, toy premiums and loyalty programs
- Develop and deliver training programs for employees and agency personnel on marketing and IP law and internal policies and procedures
- Draft and review policies with respect to marketing matters
- Manage litigation arising from areas of responsibility
- Perform other general legal duties and functions as may be assigned or required by business needs
Intellectual Property – Essential Duties
- Manage and oversee outside counsel with respect to trademark clearances, including, but not limited to knock out and full searches for U.S. and foreign jurisdictions and provide clearance opinions to client groups
- Assist in managing and overseeing outside counsel with respect to the filing and prosecution of trademark applications, responses to office actions, preparation of amendments, and other substantive submissions to trademark offices in the U.S. and foreign jurisdictions
- Assist in managing and overseeing outside counsel with respect to the maintenance of the company’s IP portfolio, including the filing of renewals around the world
- Enforce the company’s trademark rights by taking action against unauthorized third party users
Qualifications & Skills:
- Juris Doctor of Law degree from an accredited U.S. law school required
- Member in good standing of the Florida Bar or eligible for Authorized In-House Counsel status
- 6-10 years of legal experience, law firm experience required
- Transactional experience with strong drafting and negotiating skills
- Knowledge of advertising law, including consumer protection regulations and statutes enforced by the Federal Trade Commission and state attorneys general required
- Knowledge of IP law including trademarks, copyrights, domain names, trade secrets, and patents preferred
- Strong interpersonal skills and able to work in a team environment
- Highly organized and demonstrated ability to work effectively in a fast-paced setting involving multiple projects and competing timelines
